Activists are back at it again in Florida to get marijuana legalization on the ballot for 2026. This being a midterm election, the results could be different from 2024, when it narrowly lost a steep 60% needed majority. The makeup of the population that shows up for midterms are typically more right-leaning, but huge democrat backlash to Trump’s policies may change the results come next November.

Smart & Safe Florida have filed a complaint saying that the administration in the state is improperly blocking the measure from going forward. Because of this, state officials issued a letter to Smart & Safe saying they have submitted the ballot amendment.

Notably, this is still an amendment to the state constitution, meaning the measure would need to pass 60% in order to succeed. The main question will be how much public support has shifted within the last two years. According to recent polling, it’s not looking great.
