A CBD American Shaman store south of Omaha received a cease-and-desist letter from a local prosecutor ordering the removal of cannabidiol products by the end of next week.
The order comes despite the fact that hemp-derived CBD is no longer a controlled substance under federal law.
However, Nebraska state law still bans “all parts” of the cannabis plant, meaning the products are illegal in the eyes of Sarpy County Attorney Lee Polikov, the Omaha World-Herald reported.
Polikov told the newspaper that state lawmakers could change the law to accommodate CBD sales.
“It can be fixed,” he said. “The Legislature can change it.”
The cease-and-desist letter came a week after the owners of a Scottsbluff CBD store were arrested and charged with felony possession of a controlled substance.
Nebraska allows the study of hemp-derived CBD treatments at the University of Nebraska but does not regulate commercial production.
